According to the Coeur d’Alene/Post Falls Press, “Alvynn D. Allen, now 44, was accused of having sex with a woman who had passed out in an apartment after a night of drinking at the former Torch Lounge” in 2012. Allen was arrested in October 2012 and later released but wasn’t formally charged until March 2019.

The article stated that jurors were instructed: “to base their decision on whether the alleged victim was too intoxicated to resist, but little evidence was provided regarding the woman’s level of intoxication.” After a two-hour deliberation, Allen was found not guilty.

“This was a significant win for us in a conservative state like Idaho, but convicting Mr. Allen of a crime that he did not commit would’ve been a great miscarriage of justice,” said Jason Johnson, lead attorney at Johnson Litigation, PLLC. “Seven years have passed since the allegations were first made and the evidence was just not there for a conviction.”
