Well-intentioned but misplaced advice from friends and family over how a person should handle a divorce can often do more harm than good, according to family lawyer Brian M Douglas.

This is just one of the many misconceptions people often lock on to when facing the daunting prospect of splitting with partners and managing the divorce process.

In refuting the ‘friendly advice from family and colleagues, Douglas said: “Get advice from a professional lawyer who is skilled and experienced in family law and divorce before escalating matters further. They shouldn’t base life-changing decisions on incorrect, outdated and misguided advice. It could well come back to haunt them.”

The Atlanta, GA-based founder of Brian M. Douglas & Associates, LLC, also took aim at another misconception that both spouses have to agree on divorce for it to occur.

He said that to be eligible to file for divorce in Georgia, one of the parties must reside in the state for at least six months before filing. There are 13 possible grounds or reasons to cite for divorce, with the most common being the marriage has irretrievably broken down, otherwise known as no-fault divorce.

Douglas said one reason a spouse might try putting off getting a divorce is due to the widespread notion that a marriage can only be dissolved as the result of a lengthy courtroom battle.

He said that many need to be made aware that most divorces never amount to blockbuster showdowns as popularized by the media and TV. “A negotiated settlement can be achieved, in most cases, if the parties are willing to be rational and reasonable and not be driven by anger, hatred or revenge.”

Douglas said another misperception is that assets are there for the taking if one party is accused of infidelity. “When dividing the marital assets, infidelity is rarely part of the equation. However, if one party spent marital assets in pursuit of an affair, then infidelity could be factored in when a judge decides on how a marital estate should be divided.”

The sensitive subject of children caught in the middle of a divorce and who they wish to reside with is another awkward subject that often raises its head. But Douglas affirmed: “It will be a judge to decide which spouse they will live with.’’

“In some states, children over a certain age may well be canvassed by the court, but this will be just one of a number of factors that a judge will take into consideration on ultimately deciding on child custody arrangements. However, the custody arrangements will aim to benefit the child.”

He concluded: “Rather than believe in unreliable third-hand information, someone contemplating divorce should seek clear legal advice from a family attorney. This will give clarity on their future path, which could otherwise be clouded by uncertainty.”
